It depends on whether you are changing how water moves. Replacing a driveway like-for-like in the same footprint is treated very differently from widening it, adding a circular drive, or altering the pitch. This is a stormwater question before it is a construction question, which surprises people.

Why swales come into it

Much of Cape Coral drains through swales — the shallow grassed channel between your lot and the street — rather than through kerbs and gutters.
